What Is the NCTPVA?

The Nassau County Traffic and Parking Violations Agency (NCTPVA) is an administrative agency that adjudicates traffic violations, parking summonses, and red light camera citations in Nassau County. The NCTPVA moved from its former location at 16 Cooper Street in Hempstead to its current location at 801 Axinn Avenue in Garden City in 2022. The NCTPVA should not be confused with the Garden City Village Court, which is a separate court also located in Garden City.

The NCTPVA is not a traditional courtroom. It is a county administrative agency that employs both its own Judicial Hearing Officers (JHOs) and prosecutors. Unlike a village or town justice court, the NCTPVA cannot impose jail sentences for traffic infractions. Cases are resolved through conferences with prosecutors, with any agreed-upon disposition requiring JHO approval. Plea bargaining is available on most traffic violations, which gives an experienced attorney the opportunity to negotiate a reduction in charges and points on your behalf.

Which Tickets Go to the NCTPVA?

Nassau County is made up of three towns (Hempstead, North Hempstead, and Oyster Bay) and two cities (Long Beach and Glen Cove). Within those three towns are 64 incorporated villages, most of which have their own village justice courts. The NCTPVA handles traffic tickets issued in the parts of Nassau County that are not within any village — the unincorporated areas, as well as parkways and highways that do not fall within village boundaries.

If your ticket was issued by Nassau County Police, New York State Police, or a town police department on a road outside of a village, your case almost certainly goes to the NCTPVA. If your ticket was issued within a village by village police or another agency, it may go to that village’s court instead. Check the court name printed on your ticket — it will tell you where your case is returnable.

Common locations where NCTPVA-returnable tickets are issued include the Long Island Expressway (I-495), Northern State Parkway, Southern State Parkway, Meadowbrook State Parkway, Wantagh State Parkway, Loop Parkway, Seaford-Oyster Bay Expressway (Route 135), and major county roads in unincorporated areas of Hempstead, North Hempstead, and Oyster Bay.

How the NCTPVA Process Works

Step 1 — Respond to the ticket. Follow the instructions on the back of the ticket. If you want to plead not guilty, check the “not guilty” box, complete the requested information, sign the ticket, and mail it to the NCTPVA at 801 Axinn Avenue, Garden City, NY 11530. You can also appear in person during court hours. If you hire our firm, we handle this step for you.

Step 2 — Conference date. After receiving your not guilty plea, the NCTPVA will schedule a conference and mail you a notice with the date and time to appear. This conference is where the case can potentially be resolved.

Step 3 — Prosecutor conference. At the conference, your attorney meets with an NCTPVA prosecutor to discuss the case. The prosecutor reviews the charges, your driving record, and the facts of the case. In most situations, the prosecutor will offer a reduction — typically a lower charge with fewer or no points — in exchange for a guilty plea. You do not need to attend if you have an attorney.

Step 4 — JHO approval. If you and the prosecutor agree on a disposition, the case is presented to a Judicial Hearing Officer for approval. The JHO reviews the proposed plea, conducts a brief allocution, and imposes the agreed-upon fine. The fine is expected to be paid the same day.

Step 5 — Trial (if needed). If no agreement is reached at the conference, the case is scheduled for a trial before a JHO at a later date. You will be notified by mail of the trial date.

Plea by Mail Program

The NCTPVA offers a Plea by Mail program that allows eligible tickets to be resolved without an in-person appearance. A prosecutor reviews your application and driving record and responds by mail with a proposed offer. You can accept or reject the offer — there is no penalty for rejecting it, and your case will simply be scheduled for a conference or trial.

However, the Plea by Mail program has significant limitations. The following violations are ineligible: speeding tickets, second or subsequent charges within 18 months, and several other offense types. Because of these exclusions, many drivers still need an attorney to appear at a conference on their behalf. Dismissal and Reduction by Mail for Equipment Violations

Certain equipment violations — such as expired inspection (VTL § 306), broken headlights or taillights (VTL § 375), and similar equipment defects — may be dismissed if you correct the problem and submit timely proof of correction by mail to “NCTPVA — Proof of Timely Repair, 801 Axinn Avenue, Garden City, NY 11530.” Similarly, tickets for driving without a valid license, registration, or insurance may be reduced or dismissed if you can prove you had valid documentation at the time of the stop.

Out-of-Area Drivers

If you received a ticket at the NCTPVA but live far from Nassau County, you may be eligible for an out-of-area waiver of appearance. This allows your case to be handled by mail or phone rather than requiring you to travel to Garden City. NYS Driver Assessment Fees

These penalties add up fast. A single 21-mph-over speeding conviction means 6 points, up to $300 in fines, $93 in surcharges, $300 in Driver Assessment fees, and a potential insurance increase of 20% – 40% for three years. The total cost of a guilty plea can easily exceed $3,000. Fighting the ticket is almost always the better option.
